Judge William Alsup of the U.S. District Court for the Northern District of California ruled January 9 that the administration must continue the DACA program, which provides legal status to 700,000 illegal aliens who arrived in the country as children.

Moreover, a stay would not address the institutional injury suffered by the United States of being embroiled in protracted litigation over an agency decision that falls squarely within DHS's broad discretion over federal immigration policy and that is not even judicially reviewable.

The eventual ruling by the court will determine what happens to the third attempt the Trump administration has made to restrict the entry into the US of people from a number of countries that are Muslim-majority, and is the second time the USA high court agreed to hear this issue. The administration asked the court to resolve the dispute this term, but did not ask justices to immediately halt the lower court order. The justices are likely to hear arguments in the latest case in April and to issue a decision in late June.

The law does not "surrender to the president a boundless authority to set the rules of entry and override the immigration laws at will", Katyal said in court papers.

The appeals court based its ruling on immigration statutes, not the Constitution's prohibition of religious discrimination. The decision left in place a Fifth Circuit Court ruling preventing the Obama administration from expanding DACA and blocking the Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA). The order issued Friday afternoon referred specifically to the constitutional question as proposed in Hawaii's legal brief.
