The men were accused of trespassing but have said they were waiting for a friend before ordering.

The apology came after cell phone video of their arrest went viral on Thursday afternoon of the two men being cuffed in the store.

The two men were taken to a police station, where they were fingerprinted and photographed, their attorney Lauren Wimmer told the Washington Post on Saturday. "The basis for the call to the Philadelphia police department was wrong".

"I wanted to get coffee for two black guys sitting and meeting with me", he says.

Melissa DePino, who recorded the viral video of the incident, told Philadelphia Magazine that the men did not escalate the situation.

The incident is said to have started after one of the men sought to use the bathroom having not ordered. The attorney for the two men, Lauren Wimmer, told the Philadelphia Inquirer she received word that the two were being released from custody at 12:30 a.m. Friday, almost eight hours after the initial 911 call. The Philadelphia prosecutor's office also chose not to charge the men after finding there wasn't enough evidence an actual crime had been committed.

Mr Johnson said he hoped to "meet personally with the two men who were arrested to offer a face-to-face apology". Johnson released a statement saying his company "stands firmly against discrimination or racial profiling".

Among their demands are that the Starbucks employee who called police be fired, along with the officers who made the arrests.

"Did we set her up with the right protocol?" the official asked.

Thursday's incident is a dramatic turn for a company that has positioned itself as a progressive corporate leader that touts "diversity and inclusion" - efforts that have also drawn its share of criticism. When police arrived they asked the two men to leave three times but they declined, and as a result, they were arrested, Ross said. She said it was the manager at the Starbucks who called the police, and that her clients weren't doing anything wrong. He repeatedly asked an officer "what did they do?".

In his statement, Ross said he believed the officers "did absolutely nothing wrong". They followed policy; they did what they were supposed to do.

"They were professional in all their dealings with these gentlemen, and instead they got the opposite back".

Ross, who is black, references his own experiences while making his case, saying, "As an African-American male, I am very aware of implicit bias". The officers were not wearing cameras, he said.

The incident was captured on camera and inspired public outrage.

Subsequently, the Philadelphia Police Department says an internal investigation is underway following the arrest of two people at a Starbucks this week.

"Commissioner Ross and his team have promised a review of their policies moving forward with regards to response to complaints like this".

"You can and should expect more from us".

"Because these individuals refused to leave - because Starbucks actually called - the police did not just happen upon this event".

"These young men should not have received different treatment from other guests on-site and should not have been arrested in the first place", Johnson said in a statement.
