New California Internet Neutrality Law Sparks US Lawsuit

California's 'gold standard' net neutrality becomes law CA gov. signs net neutrality bill into law, Justice Department sues

The Justice Department is suing California to block a recently signed law restoring net neutrality rules that the Federal Communications Commission discarded past year.

The lawsuit filed Sunday by the U.S. Department of Justice came roughly an hour after Gov.

In rolling back net neutrality in December, the FCC also prohibited states from passing their own rules, as it would create a patchwork of laws throughout the country. Thirty other states are debating net neutrality measures of their own. "Once again the California legislature has enacted an extreme and illegal state law attempting to frustrate federal policy", Jeff Sessions, US Attorney General, said.

"I favor a free and open internet as I think most consumers do, my concern is with the particular regulations the FCC adopted two years ago, my concern is that by imposing those heavy-handed economic regulations on internet service providers both big and small we could end up disincentivizing companies from wanting to build out internet access to a lot of parts of the country", stated Pai.

"Sessions and his boss Donald Trump aren't satisfied with the federal government repealing net neutrality". Scott Wiener of San Francisco, prohibits internet providers from blocking or slowing data based on content or from favoring websites or video streams from companies that pay extra. An identical bill was introduced in NY.

USTelecom, which represents companies in the broadband sector, said it supports net neutrality but disagreed with the California law.

Barbara van Schewick, a law professor at Stanford University and an advocate for tougher net neutrality policies, agreed.

"That preemption of the states, despite the federal government relinquishing regulation itself, was upheld by the courts", Martin said, adding that it still was an act of Congress itself.

"An agency that has no power to regulate has no power to preempt the states", she said.

It's meant to replace federal rules to the same effect that were repealed last December. "We are confident that we will prevail in this case -because the facts are on our side".

"Rather than 50 states stepping in with their own conflicting open internet solutions, we need Congress to step up with a national framework for the whole internet ecosystem and resolve this issue once and for all", the group said in a Sunday statement.

"When the FCC chose to ignore the millions of consumers who urged them not to repeal net neutrality protections a year ago, it left a void that state lawmakers are now rightfully filling", Jonathan Schwantes, senior policy counsel for Consumers Union tells the Times.
