The Times, citing a police report from 1985, reported that officers questioned Kavanaugh after a bar fight while he was a junior at Yale.

According to the police report, Chris Dudley, one of Kavanaugh's friends, threw a glass at a man, hitting him in the ear, which caused his right ear to bleed.

The police report does not state that Kavanaugh initiated a fight, was engaged in a fight, or threw beer during a bar altercation. Kavanaugh was cited in the police report as having been supposedly involved in the altercation, along with three other friends during his undergraduate years at Yale.

He said that the altercation happened after a UB40 concert on September 25, when he and a group of people went to Demery's and were drinking pints. Amy Klobuchar during his hearing, Kavanaugh answered her question about whether he'd ever drank to the point of losing memory by saying, "I don't know". "This is not a man who said that he was flawless with respect to alcohol". Judge is one of multiple people the FBI has already interviewed as part of its reopened background investigation into Kavanaugh.

When asked on Fox News last Sunday and by members of Congress, Kavanaugh denied ever becoming heavily intoxicated or blacking out from drinking.

They had sent out a statement from Dudley, a former National Basketball Association player, on Monday, supporting Kavanaugh on Monday, where he said he never saw the Supreme Court nominee blackout while at Yale.

"There's no problem with drinking beer in college". It is from this experience that I concluded that although Brett was normally reserved, he was a notably heavy drinker, even by the standards of the time, and that he became aggressive and belligerent when he was very drunk. According to an NBC News report on Monday, Kavanaugh and his team were aware of the allegation before it went to press and sought to coordinate behind the scenes to refute it.

Sams, a lawyer in Atlanta who was a fraternity brother of Kavanaugh and Dudley, said he does not remember seeing Kavanaugh there.

While Bazelon and Ben Protess wrote Kavanaugh was "not arrested", she speculated on Twitter Monday night that there was "no report of an arrest" and it "could have been expunged".

Kavanaugh repeatedly admitted drinking beer during his committee testimony, pushing back against some members' questions about just how much he drank.
